Terms and Conditions for Landscaping Tooting

Landscaping team beginning a garden service with tools and materialsThese Terms and Conditions set out the basis on which landscaping services in Tooting are supplied by us to you. By requesting a quotation, making a booking, or confirming a service, you agree to be bound by these terms. They are intended to create a clear, fair agreement for both residential and commercial customers seeking Tooting landscaping services, garden maintenance, soft landscaping, hard landscaping, planting work, turfing, clearance, and related outdoor works. Please read them carefully before placing an order.

In these Terms and Conditions, references to we, us, or our mean the landscaping service provider, and references to you or your mean the customer receiving the services. These terms apply to all quotations, bookings, and works carried out by us unless we agree otherwise in writing. If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply in full.

These terms are designed to support a professional landscaping Tooting service while preserving flexibility for the practical nature of outdoor work. Landscaping jobs may be affected by weather, access, hidden site conditions, material availability, and waste disposal requirements. For that reason, the service description, scope, and pricing for each project may be confirmed individually in writing before work begins.

Customer booking a landscaping appointment and reviewing service detailsWe aim to make the booking process straightforward. A booking may begin with an initial enquiry, followed by an assessment of the site, a discussion of the work required, and then a written quotation or estimate. The quotation may set out labour, materials, equipment, waste handling, and any exclusions. A booking is not confirmed until you accept the quotation and we confirm a start date or service date.

Where a site visit is needed before quotation, you agree to provide safe and reasonable access. You should ensure that the area to be worked on is accurately described and that any known restrictions, such as shared access, parking limitations, fragile surfaces, underground services, pets, or vulnerable plants, are disclosed before booking. If your instructions change after confirmation, we may revise the price, schedule, or scope of work to reflect the updated requirements for your landscape maintenance and garden services.

All bookings are subject to availability. We may offer a provisional date, and if so, that date may change due to weather, supplier delays, staff availability, or other operational reasons beyond our reasonable control. For larger or phased projects, we may split work into stages and may require your approval before proceeding from one stage to the next. Any variation to the agreed work should be confirmed in writing or by other recordable means.

Payment and invoice arrangement for landscaping servicesPayments must be made in accordance with the quotation, invoice, or written agreement provided to you. Unless stated otherwise, prices are quoted in pounds sterling and may be inclusive or exclusive of VAT depending on our business status and the wording of the quotation. We may request a deposit for materials, larger projects, or booked dates reserved in advance. Any deposit paid will be applied against the final amount due unless otherwise specified.

Payment becomes due on the date stated in the invoice or, if no date is stated, immediately upon completion of the work. For some services, especially one-off landscaping services Tooting customers arrange during busy periods, payment may be required on the day of completion. We may accept bank transfer, card payment, or another agreed method. Cheques and cash may be refused unless agreed in advance. You must ensure that payments are made from a valid account and that all banking details are used correctly.

If you fail to make payment on time, we reserve the right to charge interest and recovery costs to the extent permitted by law. We may also suspend further work, withhold delivery of materials, or cancel future bookings until outstanding sums are settled. Any discounts, promotional prices, or special rates apply only to the specific service and period stated and may be withdrawn for amended work or additional requests. Where materials are ordered specifically for your job, you may be liable for those costs if you cancel after ordering.

Cancellation terms depend on the type and timing of the booking. If you wish to cancel or postpone a confirmed service, you should notify us as soon as possible. For standard domestic work, cancellations made with reasonable notice may not incur a charge, but we may retain or invoice for any costs already incurred, such as purchased materials, reserved labour, or administrative expenses. For urgent, bespoke, or high-value landscaping Tooting projects, cancellation charges may apply where we have already committed resources to your job.

If you cancel after we have attended the site, commenced preparation, or started work, you may be charged for the work completed up to the point of cancellation, together with any non-recoverable expenses. If we need to cancel or rearrange a booking, we will try to provide reasonable notice and offer an alternative date where possible. We will not be responsible for losses arising from a cancellation or delay caused by events outside our reasonable control, including severe weather, fire, flood, supply shortages, or restrictions imposed by authorities.

You acknowledge that outdoor work is often weather-dependent. If conditions are unsafe or likely to prevent proper completion, we may postpone or reschedule the visit. In such cases, we will use reasonable efforts to inform you and minimise disruption. Delays caused by access problems, missing instructions, or late approval of materials are not our responsibility. If a project is paused at your request, additional charges may apply for remobilisation, storage, or return visits.

Garden project underway with site preparation and safety measuresWe will carry out services with reasonable care and skill, using suitable materials and equipment consistent with the agreed scope. However, landscaping work may involve natural variation, and results can differ due to soil condition, weather, drainage, existing vegetation, and the age or quality of existing structures. Unless expressly stated, we do not guarantee that living plants, turf, or newly installed materials will establish in all circumstances, as survival depends on aftercare, environment, and factors outside our control.

Our liability for any loss or damage caused by our negligence is limited to the amount paid or payable for the specific service in question, except where liability cannot lawfully be limited. We do not exclude liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law. We are not responsible for pre-existing defects, hidden pipes, cables, buried objects, unstable ground, or other site conditions that were not reasonably apparent before work began.

Where we provide recommendations relating to planting, drainage, maintenance, or materials, these are based on general professional judgment and the information available at the time. Any advice should be treated as guidance for the agreed project rather than a guarantee of outcome. It remains your responsibility to notify us of any allergies, property constraints, or protected features before work starts. You are also responsible for ensuring that children, pets, and third parties are kept away from active work areas unless we agree otherwise.

Waste removal from a landscaping job handled in accordance with regulationsWaste removal and disposal are subject to applicable environmental and waste management regulations in England and Wales. When we remove green waste, soil, rubble, packaging, timber, or other materials, we will handle them in accordance with the law and with reasonable care. Waste may be taken to a licensed facility or handled by an authorised carrier. If waste transfer notes, carrier details, or other records are required, we may retain them in line with legal obligations.

You must not ask us to dispose of prohibited, hazardous, or regulated items unless we have expressly agreed and are legally able to do so. This includes, without limitation, asbestos, chemicals, paint, fuel, contaminated soil, electrical waste, gas cylinders, or any item requiring specialist handling. If such items are discovered on site, we may suspend work, charge for extra handling, or require you to arrange removal through an approved specialist. Any waste not included in the original quotation may be charged as an additional item.

You are responsible for disclosing in advance any known waste issues, restricted access, or special disposal requirements associated with your property. If waste volumes exceed the estimated quantity, or if the material differs from what was described at the time of booking, we may revise the fee accordingly. We will not be liable for delays or extra costs arising from inaccurate information about waste, site conditions, or the scope of clearance required.

All materials supplied by us remain our property until paid for in full, where such retention is permitted by law. Risk in materials may pass to you upon delivery or installation, depending on the nature of the work and the point at which the materials are incorporated into your property. Once planting, turfing, paving, or construction materials have been installed and the site has been handed over, you are responsible for routine care, watering, and maintenance unless ongoing care is expressly included in the agreement.

Any dates, measurements, estimates, or completion times are provided in good faith but are not guaranteed unless explicitly stated as fixed. Minor changes in dimensions, quantities, or finishes may occur due to site realities and the practical nature of landscaping work. If you request changes after the job has started, we may charge for the extra labour, materials, and time involved. A change order, revised quotation, or written confirmation may be issued before the additional work proceeds.

We may refuse, suspend, or end a booking if your conduct makes it unsafe, unlawful, or impractical to continue. This includes abuse, threats, refusal of reasonable access, or failure to follow agreed safety measures. If the relationship ends for these reasons, you must pay for work completed and any costs already committed. We may also terminate if you fail to pay, provide false information, or materially breach these terms.

Personal data supplied in connection with your booking will be used to manage the provision of services, administration, accounting, legal compliance, and record-keeping. We will handle such data in line with applicable data protection laws and any privacy notice we make available separately. We will not use your information for unrelated purposes unless permitted by law or with your consent. You should ensure that any information you provide is accurate and kept up to date.

These Terms and Conditions, together with the quotation or written agreement relating to your specific landscaping project, form the entire agreement between us and you for that service. If there is any conflict between the quotation and these terms, the written quotation will prevail to the extent of the inconsistency. No person who is not a party to the agreement has any right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the agreement unless we agree otherwise in writing.

Governing law: These Terms and Conditions and any dispute or claim arising from them, or from the supply of landscaping services in Tooting, shall be governed by and interpreted in accordance with the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales. By booking our services, you confirm that you have read, understood, and accepted these terms for your landscaping project.
